Tail Health Terms of Use

These terms apply when you use Tail Health, an iPhone app made by Four Birds Limited, New Zealand ("we", "us"). By signing in to Tail Health, you agree to these terms and to the Tail Health Privacy Policy.

1. Who Can Use Tail Health

Tail Health is for veterinarians and the people who work with them. Accounts are set up by us on request. You must be at least 18 and able to agree to these terms. If you use Tail Health for a practice or business, you confirm you're allowed to agree to these terms on its behalf.

2. Your Account

Keep your sign-in details private and tell us straight away at hello@tailhealth.app if you think someone else has used your account. You're responsible for what happens under your account.

3. Your Records

The farm and animal records you enter or import, including herd files and tail scores, remain yours. You give us permission to store, back up and process them only to run Tail Health for you, as described in the Privacy Policy.

You're responsible for:

• Having the right to enter or import the information, including any farm or herd data that belongs to your clients.
• Following any terms, licences or privacy policies that apply to information you bring in from somewhere else, such as a herd file exported from another app, farm system or person.
• Only entering or importing information you're allowed to share and that's needed for your work, and not uploading anything that wasn't meant to be shared.
• Checking that your records and exports are accurate before relying on them or sharing them.
• What you, your clients or anyone you share them with do with your records and exports.

Tail Health is a recording tool: it stores what you choose to enter or import. We don't check, verify or monitor that information or where it came from, and we aren't responsible for it, for whether you had the right to upload it, or for what happens to it after it leaves Tail Health.

4. Professional Judgement

Tail Health is a recording tool. It doesn't diagnose or give veterinary, animal welfare or regulatory advice, and it doesn't replace your professional judgement. Decisions about animals and herds remain yours.

5. Acceptable Use

Don't misuse Tail Health. For example, don't try to access other people's accounts or data, interfere with the service, reverse-engineer it except where the law allows, or use it for anything unlawful.

6. Availability and Changes

We work to keep Tail Health available and your records backed up, but we can't promise it will always be available or error-free. Tail Health stores records on your phone and works offline; keep exporting the results you need. We may change or improve Tail Health, and we'll tell you before we make a change that significantly reduces what you can do.

7. Ending Your Use

You can stop using Tail Health and delete your account at any time in the app under Settings → Delete account. We may suspend or close an account that breaks these terms, or if we stop offering Tail Health; where we can, we'll give you notice and a chance to export your records first.

8. Liability

Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or other laws that can't be excluded. If you use Tail Health in trade, you agree that the Consumer Guarantees Act doesn't apply.

To the extent the law allows, we aren't liable for indirect or consequential loss, for loss caused by records being entered incorrectly, or for information you entered or imported without the right to, and our total liability to you for any claim about Tail Health is limited to NZ$100 or the amount you paid us for Tail Health in the 12 months before the claim, whichever is greater.

9. Apple

These terms are between you and Four Birds Limited, not Apple. Apple isn't responsible for Tail Health or its content, and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of the app must also follow the App Store's terms of use.

10. Changes to These Terms

We may update these terms. The current version will be on this page with the date of the latest update. If a change is significant, we'll tell you in the app or by email before it takes effect.

11. Law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
